Over the past 30 years, computer engineering has developed a lot. Currently, computer and software applications have a central role in business, medicine, security, communications, industry, education, and everyday life. Software developers, peoples who manage computer networks, data security analysts can do well, but they also have the potential to cause suffering and harm to the clients or ordinary peoples, willingly or not. For this reason, IT activities must be regulated by specific laws. From the beginning, we argue that the (...) law is not the same thing as ethics, even if both promote the good. Certain ethical principles can be strengthened by law. In the field of computer science and technology, can exists theft, privacy violations, violence and harassment. To combat and punish such actions and behaviors, law is needed. But is software engineering a profession? If so, are there codes of professional ethics whereby specialists in the field can regulate their professional activity, as is the case, for example, in areas such as justice or medicine? In relation with that, Gibbs and Ford have identified 8 components of a professional infrastructure. Some of that is: initial vocational training, professional accreditation, licensing, continuous vocational training, the existence of code of ethics.. With the fact that software engineering is a profession, in this article we present the main principles of behavior. The principles are not legally binding. We integrate information from distinct domains, especially in metaphor. What sort of cognitive architecture underlies this kind of integration? Fodor (1983) argued that it involves nonmodular mechanisms. He also contended that the nonmodular mechanisms evolved from modular ones through a process of demodularization, a position elaborated by Mithen (1996). In this article, I defend Fodor and Mithen from criticisms offered by Sperber (1994). Sperber suggested that nonmodular mechanisms are unlikely to have evolved because an increasingly large database would incapacitate the (...) cognitive system due to combinatorial explosion and the frame problem. Moreover, he argued that nonmodular mechanisms are not required to explain our ability to integrate information. I argue that proponents of demodularization can respond to Sperber's criticisms by assuming that either an expanding database co-evolved with increasingly sophisticated search mechanisms or the cognitive system evolved along connectionist lines. Moreover, I argue that Sperber's modular account of conceptual integration fails to satisfy the criteria for modularity-namely, information encapsulation. (shrink)

According to Goodman (1972), two things are similar only if they possess relevant common properties. The relevance of properties, however, can vary with the context and with the goals of the person making the comparison. As a result, similarity is a highly unstable relation, and therefore difficult to use as a base from which to explain other processes, such as analogy, induction, categorization, and metaphor. A recent attempt by Gentner and her colleagues to explain the operations of the comparison process (...) in analogy may run across some of these difficulties. In particular, her structure-mapping theory (Gentner, 1983, 1989; Gentner & Markman, 1997) does not explain how the relevant features are accessed during the early stages of the comparison process. Moreover, progress on this problem will not be made until we have a solution to a more general problem--the problem of explaining how people manage to bring relevant information to bear in the processing of new information. The theories of information ethics articulated by Luciano Floridi and his collaborators have clear implications for law. Information law, including the law of privacy and of intellectual property, is especially likely to benefit from a coherent and comprehensive theory of information ethics. This article illustrates how information ethics might apply to legal doctrine, by examining legal questions related to the ownership and control of the personal data representations, including photographs, game avatars, and consumer profiles, that have become ubiquitous with the (...) proliferation of information and communication technologies. Recent controversy over the control of player performance statistics in “fantasy” sports leagues provides a limiting case for the analysis. Such data representations will in many instances constitute the kind of personal data that information ethics asserts constitutes an information entity. Legal doctrine in some instances proves sympathetic to such an assertion, but remains largely inchoate as to which data might constitute a given information entity in a given instance. Neither is information ethics, in its current state of development, entirely helpful in answering this critical question. While information ethics holds some promise to bring coherence to this area of the law, further work articulating a richer theory of information ethics will be necessary before it can do so. At common law, contributory infringement for copyright infringement requires "knowledge" of the infringing activity by a direct infringer before secondary liability can attach. In the USA, the "safe harbor" provisions of the Digital Millennium Copyright Act, that shield Internet Service Providers from secondary copyright liability, are concomitantly available only to ISPs that lack the common law knowledge prerequisites for such liability. But this leads to the question of when a juridical corporate entity can be said to have "knowledge" under the (...) statute. Legal institutions have well-established processes for inferring the knowledge state of natural persons, but corporations are complex sociotechnical networks of human and non-human elements whose information state does not map well onto such inferential methods. This question is of course not unique to copyright liability; corporate entities may be responsible for "knowing" actions under a variety of applicable legal provisions, and the question of corporate knowledge is generally under theorized. But consideration of ISP "knowledge" in this context points the way to consideration of corporate epistemology that must be foundational to determining corporate responsibility in copyright protection. © The Author 2011. Managing ethical behavior is a one of the most pervasive and complex problems facing business organizations today. Employees' decisions to behave ethically or unethically are influenced by a myriad of individual and situational factors. Background, personality, decision history, managerial philosophy, and reinforcement are but a few of the factors which have been identified by researchers as determinants of employees' behavior when faced with ethical dilemmas. The literature related to ethical behavior is reviewed in this article, and a model for understanding (...) ethical behavior in business organizations is proposed. It is concluded that managing ethics in business organizations requires that managers engage in a concentrated effort which involves espousing ethics, behaving ethically, developing screening mechanisms, providing ethical training, creating ethics units and reinforcing ethical behavior. Extending the work of Davidson and Worrell, we further investigate the stock market''s reaction to announced corporate illegalities. We examine a sample of 535 announcements of corporate crime and obtain an overall insignificant stock market reaction. However, when the sample is divided by type of crime, we find that the stock market reacts significantly to announcements of bribery, tax evasion, and violations of government contracts. We also find a significantly negative reaction to announcements of corporate crime when the company had (...) been previously accused of other illegal activity. For companies accused of crime in the 1970s, 51% of them were accused again in the 1980s. (shrink)

In this article, we hypothesize that the level of environmentally oriented noncompliance regulatory fines and penalties levied on companies and on their industry counterparts will be associated with the development of an environmental infrastructure and practices within these companies. We find that the presence of these regulatory actions is associated with the likelihood of companies reporting environmental policies and activities and with the presence of a separate board of directors’ committee that monitors company environmental concerns. Our findings suggest that environmental (...) regulatory pressure may serve as a driver of environmental action but is not its only determinant. (shrink)

In this research, the authors present a model that demonstrates that motivating managers to change unpopular or irresponsible corporate behavior may be required when the stakeholders desire such a change. Using agency theory, they then test part of the model and demonstrate why it may be necessary for an organized protest to impact on share prices before managers choose to change the behavior. Investors' reactions to announcements of product boycotts and stock divestitures made over the 23-year period 1969-1991 were examined. (...) Announcements about boycotts were associated with significant negative market reactions, whereas divestiture announcements resulted in no significant market responses. From a pure stock market perspective, boycotts appear to be a more effective tool in influencing managers to change a company's behavior. (shrink)

The area of biomedicine is one of the fastest developing areas of science and technology. The perception of its possible and expected positive or negative impacts results in the growing number of bioethical discussions in scientific community, politics and public. Their intensity, focus and used methods differ from country to country. Th e authors of the prologue have tried to map the state of the art and expected development of bioethical discussion in the countries of Middle and Eastern Europe. In (...) the beginning, they addressed the bioethical experts with short questionnaire from 7 “new” European countries and two “old” European countries. In the end, seven experts have responded their questions and expressed their expectations and difficulties of the development of bioethical discussions and institutionalisations in their countries. Dans son ouvrage majeur, le Kuzari, Juda Hallévi déploie une critique précise de la philosophie, au profit de la révélation du Sinaï. Nous entendons montrer que cette critique est liée à la situation historique des Juifs qui suscite la rédaction du Kuzari (I), qu’elle s’adresse à un type assignable de philosophie (II) à laquelle elle substitue l’histoire (III). Ce faisant, il ne s’agit absolument pas pour Juda Hallévi de renoncer à toute exigence rationnelle, mais de la satisfaire en la resituant (...) en son vrai lieu (IV). Cet examen permet d’éclairer, certes par le petit bout de la lorgnette, mais à travers une pensée qui occupe au Moyen Âge une position originale, une partie des enjeux qui traversent les rapports entre foi et raison dans la philosophie juive médiévale en terre d’Islam. Abstract Energy typically is discussed in terms of science, technology, economics, and politics. Little attention has been given to fundamental religious and ethical questions surrounding the upcoming transition to renewable energy. The essays in this thematic section seek to redress that deficiency. This introductory essay raises some key questions and summarizes various presentations on energy and religion, as these were held at the 2010 conference of the Institute on Religion in an Age of Science (IRAS). Some presentations described the energy (...) landscape and provided data and perspectives needed for sound policy. Others raised ethical and religious considerations for energy decisions as the transition from nonrenewable to renewable sources is faced. Some posed the challenges of the energy transition to religion itself. Yet others offered examples of sustainable energy use and/or promising sources for meeting future needs sustainably. At the conclusion of the conference, presenters crafted a common “Statement on Energy and Climate Change” that includes a “Call to Action.” The “Energy Statement” follows as an appendix. (shrink)

This study of major corporations (n=481) provides an empirical assessment of the effects of several corporate governance variables (CEO duality, boards of director composition, officers and directors common stock holdings, institutional common stock holdings, number of majority owners) on the adoption of so-called severance agreements. A discriminant analysis indicates a significant multivariate function. Wilks lambda univariate analyses suggest that the percentage of common stock held by owners and directors and number of majority stock holders are the more robust discriminators.

Psikolojinin bir bilim dalı olarak ortaya çıktığı 19. yüzyıla kadar, insana dair sorunlar, felsefi bir yorumla ele alınmıştır. Zaman içinde pozitivizm, materyalizm gibi felsefe akımlarının yön vermesiyle psikoloji bilimi kendine ait kavram ve yöntemlere sahip olmuştur. Bu süreçte bilimde hâkim olan paradigmaların etkisiyle din, uzun bir dönem bilimsel araştırmaların dışında tutulmuştur. Bilim adamalarının dine karşı olumsuz tutumlarına rağmen, Hıristiyan din adamaları felsefe ve psikoloji gibi alanlardaki bilimsel gelişmeleri yakından takip etmişlerdir. Kilise hizmetleri çerçevesinde geleneksel olarak sürdürülen “pastoral care” faaliyetlerinin psikoloji (...) ve psikoterapi alanlarındaki gelişmelerden etkilenmesiyle bugünkü dini danışma ve rehberliğin temeli olan “pastoral care and counseling” kavramları ve yöntemleri ortaya çıkmıştır. 1960’lardan sonra dünya genelinde bir yayılma eğilimi gösteren dini danışma ve rehberlik konusu, son yıllarda Türkiye’deki dini kurum ve akademik çevrelerin de ilgi odağı haline gelmiştir. Bu makalede, konunun İslam kültürü içindeki realizasyonu ile ilgili çalışmalara katkı vermek amacıyla dini danışma ve rehberliğin temel kavramları ve tarihi arka planına odaklanılmıştır. Modern yaşam biçimi toplumsal değişimi hızlandırmakla kalmamış bireysel ihtiyaçları da bir hayli değiştirmiştir. Yaşanan hızlı değişim ve farklılaşan ihtiyaçlar bir takım psikolojik problemleri beraberinde getirmiştir. Buna bağlı olarak insanı olumsuz etkileyen ve hastalanmasına yol açan psikolojik süreçler incelenmeye başlanmıştır. Öte yandan değişimden hayatın değer ve inanç sistemleri de etkilenmiş, kurumsal dini yapılarda ve din hizmeti anlayışlarında önemli değişme ve gelişmeler meydana gelmiştir. Bu sebeple bir taraftan yeni ortaya çıkan olay ve durumlar karşısında dinin bakış açısını ve tutumunu öğrenme ihtiyacı, diğer taraftan yaşanan acı ve krizler karşısında psikolojik yardım ve manevi destek gereksinimleri giderek artmıştır. Kısacası din, insanların kendi başlarına hareket etmekte zorlandığı, rehberliğe ihtiyaç duyduğu bir alan olmuştur. Dini danışma ve rehberlik alandaki ilk çalışmalar, tamamen bir Hıristiyanlık faaliyeti olarak ortaya çıkmış olduğu için bu alana ait ilk kavramlar da Hıristiyan kültürü ile yakından ilgilidir. Dini danışma ve rehberliğin temel kavramlarından olan “pastoral care” genellikle rahip ya da papazların özellikle kilise dışında yürüttükleri dini danışmanlık ve rehberlik hizmetlerini ifade etmektedir. Günümüzdeki dini danışma ve rehberlik hizmetlerinin temelini, Hıristiyan din adamlarının verdiği manevi destek, öğüt ve tavsiye anlamındaki pastoral care faaliyetleri oluşturmaktadır. Ayrıca kavramların, Mesih ve teslis inancı; günahsızlık ve günahların kefareti, lütuf yoluyla kurtuluş öğretileri; papazların yanılmazlığı ve ruhbanlık anlayışı; itiraf müessesesi ve kilisenin statüsü gibi Hıristiyan teolojisine ait kökenleri bulunmaktadır. Pastoral care ve pastoral counseling birbirlerinden bir dereceye kadar ayırt edilebilen yardım şekilleridir. Aralarındaki farklılık, papazların insanlarla çalışırken, ilgili psikolojik dinamikler yerine kendilerinin ahlaki duruş mesafelerinden kaynaklanır. Bu nedenle ikisi arasında en geniş ve kapsayıcı pastoral faaliyet, kesinlikle pastoral care çalışmalarıdır. Bu çalışmalar, resmi ve gayrı resmi konuşmalar, diyaloglar ve diğer iletişim etkileşimleri ile gençler, çiftler, yetişkinler ve çeşitli diğer gruplarla daha fazla ya da az yapılandırılmış genel ilişkilerdir. Pastoral counseling olarak adlandırılan yardım ilişkileri ise pastoral care faaliyetlerinin genel ve her yerde uygulanabilirliğinden farklı şekilde, bireylerin belirli bir yerde ve belirli bir süre tahdidi çerçevesinde yapılandırılmış olan yardım faaliyetlerini içerir ki, böyle bir yardım sürecinde papazın dikkatini ve zamanını gerektiren durumlar söz konusudur. Burada ayırt edici nokta, bireyin psikolojik durumu ve sorunlarının daha fazla olmasıdır. Dini danışma ve rehberliğin kurumsal bir hizmet alanı olarak ortaya çıkışı, reform hareketleri ve sanayi devriminin Batı Avrupa ülkelerinin sosyal dokusu ve dini kurumların yapılanması üzerinde yaptığı değişimle doğrudan alakalıdır. Nitekim Katolikler ve özellikle Ortodokslar yeni gelişen psikolojik danışma faaliyetlerinde daha temkinli bir tutum takınırken Protestanlar dini destek ve yardım hizmetlerinde yeni psikolojik teori ve teknikleri kucaklama eğilimi göstermişlerdir. 15. yüzyıldan itibaren oluşan, insana, Tanrı’ya ve âleme bakıştaki farklılaşmanın gerçekleştiği süreç, 18. yüzyılda “aydınlanma” olarak adlandırılan köklü bir değişimi beraberinde getirmiştir. Doğaüstünün doğayla, dinin bilimle, tanrısal buyruğun doğa yasasıyla, din adamlarının filozoflarla yer değiştirmesi ve dini inanca toleransın azalması ile karakterize edilen bu dönemde, din ve maneviyat konusu, psikolojik araştırmalar ve klinik deneyler dışında tutulması gerektiğine inanılan, kişilere özgü, bilim dışı, bilinmez bir özel alan olarak görülmüştür. Psikolojinin bir bilim dalı olarak ortaya çıktığı dönemde bilimsel sahada hâkim olan paradigmanın etkisiyle bilim adamaları her ne kadar din ile sağlıklı bir ilişki kuramadıysa da; özellikle Amerika ve Avrupa’da kilise hizmetleri çerçevesinde “pastoral care” faaliyetlerini yürüten din adamları, modern psikiyatri ve psikoterapi birikiminden etkili bir şekilde yararlanmışlardır. Kilise faaliyetlerinin psikoloji alanındaki gelişmelerden etkilenmesiyle papaz ve rahiplerin dini konulardaki yardım çalışmaları hem kilise içinde hem kilise dışında daha profesyonelce yürütülen faklı bir boyut kazanmaya başlamıştır. Papazların yetiştirilmesinde danışma psikolojisi ve klinik psikolojinin yöntem ve kurallarının kullanılmaya başlamasıyla “pastoral counseling” alanı gelişme göstermeye başlamıştır. Abraham Maslow’un “kendini gerçekleştiren kişiler” hakkındaki araştırmasına kadar (1962) ilgiye layık görülmeyen din ve maneviyat, bu araştırma sonucunda, karşılanması gereken nihai bir ihtiyaç ve önemli bir motivasyon olarak fark edilmiştir. Alanda son yapılan araştırmalar, din ile ruh ve beden sağlığı arasında önemli ilişkilerin olduğunu ortaya koymaktadır. Danışmanlarca, danışanların dini inançlarının danışma sürecine dâhil edilmemesi; danışanın kimliğinin işe yarayan önemli bir bölümünü yok saymakla eş anlamlı kabul edilmektedir. Bu gelişmelerin sonucu olarak bugün başta ABD ve diğer gelişmiş ülkelerde birçok Tıp Fakültesi ve Psikoloji bölümleri, programlarına dini danışmanlıkla ilgili dersler koymaktadır. 20. yüzyılın başından beri Hıristiyan Batı dünyasında uygulanmakta olan pastoral care and counseling faaliyetleri, toplumsal değişmenin küresel etkileri ve gittikçe benimsenen modern yaşamın farklılaşan ihtiyaçlarına bağlı olarak son yıllarda Türkiye’deki akademik çevrelerin ve ilgili kurumların ilgi odağı haline gelmiştir. Dini danışma ve rehberlik, kültürümüzde henüz yabancı bir kavram ve kurumsallaşmamış bir hizmet alanı olarak kabul edilse de; Hz. Peygamber’den (s.a.v) bu yana sürdürülen din hizmetlerinin en önemli bölümünü, özü dini rehberlik olan irşat faaliyetleri oluşturmaktadır. Ancak günümüzde modern psikolojik yardım disiplinlerinin ilke ve yaklaşımlarından destek alan yeni irşat modellerine ihtiyaç vardır. Dini danışma ve rehberlik, amaç, ilke, yöntem ve yaklaşımları ile toplumda oluşan yeni ihtiyaç ve beklentileri karşılamaya yönelik sürdürülen çabalara önemli katkılar sağlayacaktır. (shrink)

À partir de l’indécision apparente du concept de substance dans le corpus cartésien, on formule l’hypothèse que le « traité de la substance » des Principia I peut jeter une lumière sur les Meditationes (§ 1) ; en effet les Principia I développent deux définitions de la substance, tantôt comme chose existante par soi, tantôt comme support des attributs (§ 2) ; or ces deux définitions correspondent exactement aux deux lieux des Meditationes mobilisant la substance : la Meditatio III recourt (...) à la substance des Principia I, 51, et la Meditatio VI recourt à la substance des Principia I, 52 (§ 3). On en déduit que le cogito de la Meditatio II ne saurait remonter de l’attribut principal à la substance suivant la logique de Principia I, 52 (§ 4) et que l’ ego, alors entendu selon Principia I, 51, ne pouvait que perdre sa substantialité dès l’instant que se trouvait exhibée sa dépendance envers Dieu, à la fin de la Meditatio III (§ 5). Dès lors, les Principia nous paraissent trancher des indécisions cartésiennes avec une certaine efficacité (§ 6). (shrink)

Quelle place l'infinité divine occupe-t-elle dans la philosophie cartésienne? Peut-elle éclairer la situation de Descartes dans le temps long de l'histoire de la métaphysique ou révéler une béance toujours sise au coeur de son concept? Loin d'être une innovation cartésienne, l'infinité de Dieu constitue une conquête de l'histoire de la métaphysique, qui, en prenant pour objet le concept d'ens, s'est approprié Dieu sous la figure de l'ens infinitum. Et parce que la philosophia prima des Meditationes a pour premier principe le (...) cogito, l'idea infiniti ne peut que s'ordonner à l'univocité de la cogitatio et se soumettre au régime métaphysique de la représentation, qu'elle prolonge et accomplit. Mais Descartes confère à l'infini une autre détermination, qui contredit sa portée métaphysique : car, en toute rigueur, l'infini ne se donne pas tant en une représentation, qu'il n'excède toute représentation pour la conditionner. Ainsi Descartes démontre-t-il l'existence de Dieu au moyen du nom qui énonce d'abord sa transcendance à toute démonstration ; ainsi l'idée d'infini est-elle plus "lourde" que l'ego qui la porte et qu'elle creuse d'une antériorité à jamais irrécupérable. Descartes a donc associé en un même nom - l'infini - une détermination métaphysique et une détermination non métaphysique de Dieu. Mais cette double détermination traduit l'ambiguïté même de l'infini dans l'histoire de la métaphysique, s'il est vrai que c'est aussi bien comme infini que Dieu y est entré (Duns Scot) et qu'il en est sorti (Levinas). L'infinité divine peut dès lors accomplir chez Descartes la sortie de la métaphysique depuis la métaphysique elle-même, puisqu'elle nomme l'au-delà de la représentation apparu depuis la représentation : la métaphysique se trouverait alors contemporaine de sa fin, qui toujours en sourdine la double et la défait. En la déployant sans nuances, Descartes fait accéder à sa visibilité la plus haute l'ambiguïté de l'infini : sa métaphysique en acquiert une ambivalence à laquelle nous n'avons pas voulu demeurer aveugle. Les partis d’extrême-droite ont traditionnellement cherché à désavouer la science (ou la responsabilité) de la dégradation écologique, en la présentant comme une conspiration destinée à profiter aux « élites mondialistes » ou à saper la souveraineté nationale par le biais d’accords multilatéraux. Toutefois, ce discours environnemental n’est plus aussi central pour l’extrême-droite parlementaire qu’il ne l’était dans les années 2000 et 2010. La science du climat est de plus en plus tacitement acceptée, mais l’extrême-droite impute la responsabilité du problème à (...) celles et ceux qu’elle désigne comme ses ennemis traditionnels : les migrant·es. Ces partis ont ainsi forgé un nouveau discours environnemental distinctif, que cet article propose de conceptualiser sous le nom d’« écofrontiérisme » ( ecobordering ). (shrink)

Dan Arbib | Résumé : Nous proposons ici une analyse du concept cartésien d’infini à partir de trois paradoxes : 1) du point de vue du corps cartésien, l’infini occupe deux places peu compatibles, à la fois fondateur de la rationalité et inséré en elle ; 2) du point de vue de l’histoire de l’histoire de la métaphysique, l’infini apparaît pour satisfaire l’exigence de la représentation et pour y déroger ; 3) du point de vue de l’histoire des noms divins, (...) les enjeux du nom de l’infini se trouvent par deux fois neutralisés, d’une part par le scotisme contre l’effort thomiste ou bonaventurien, d’autre part par les post-cartésiens contre les plus grandes audaces cartésiennes. — Ces trois paradoxes superposables questionnent la cohérence du dispositif cartésien dont l’infini constitue le coeur. |: I propose here an analysis of the Cartesian concept of infinity based on three paradoxes : 1) from a Cartesian viewpoint, infinity occupies two places which are potentially incompatible, both as founder of rationality and inserted in it ; 2) from the viewpoint of the history of metaphysics, infinity appears to satisfy the requirement of representation and to break it ; 3) from the viewpoint of the history the divine names, the stakes of the name of infinite are twice neutralized, first by scoticism against Thomas Aquinas or Bonaventure, then by post-Cartesian philosophers against Descartes’ boldness. — These three superposable paradoxes question the coherence of the Cartesian system of which infinity constitutes the centre.
